Buying in Minnesota: what to know

Taxes buyers pay

The borrower pays Minnesota’s mortgage registry tax: 0.23% of the loan, or 0.24% in Hennepin and Ramsey counties. That is $736 on a $320,000 loan at 0.23%.

Deed tax

Minnesota’s deed tax is 0.33% of the price minus any mortgage the buyer assumes, with a flat $1.65 when the price is $3,000 or less. It is the seller’s liability under the standard purchase agreement, though a contract can assign it to the buyer. Hennepin and Ramsey counties add 0.01%, for 0.34% there.

Title insurance

Under the standard Minnesota purchase agreement the seller furnishes title evidence, an abstract continued at the seller’s cost, and the buyer buys the owner’s policy. Some sources report seller-paid policies, so it is negotiable. Each side pays its own closer’s fee.

Who runs the closing

Minnesota doesn’t require an attorney. Title-company closers handle most closings.

Property taxes and escrow

Minnesota taxes are paid in the year they’re payable, in two halves due May 15 and October 15, and prorated on a calendar-year basis to the closing date. Before May 15 the seller credits the buyer for January 1 to closing; after paying a half, the seller may be reimbursed for days after closing. Any prior-year delinquent taxes are the seller’s.

Local differences

Hennepin and Ramsey add a 0.01% environmental tax to the deed and mortgage taxes. Ten counties (Anoka, Carver, Dakota, Hennepin, Ramsey, Scott, Waseca, Washington, Winona and Wright) charge a flat $5 conservation fee on each deed and mortgage. A well disclosure certificate costs $54 to file when the property has a well.

Minnesota by county

Most of Minnesota follows the rules above. These counties add a tax of their own, set a different rate or change who pays, and the calculator applies them when you pick one. Amounts are what the buyer usually pays in transfer and deed taxes on $345,000 with 20% down, plus the owner’s title policy where the buyer usually buys it.
