Buying in Delaware: what to know

No buyer’s taxes

Delaware has no mortgage tax. The buyer’s main tax is their half of the transfer tax. First-time buyers pay less: their share of the state tax drops by 0.5% of the price on up to $400,000, and counties exempt first-time buyers on at least the first $400,000. The seller’s half stays the same.

Realty transfer tax

Delaware’s realty transfer tax is usually 4% in total: 2.5% to the state plus 1.5% to the county or town. Where a locality levies less than 1.5%, the state rate is 3% instead. By law it is split equally between seller and buyer, so on a $400,000 sale each side pays about $8,000.

Title insurance

The buyer customarily pays for the owner’s policy in Delaware. Confirm with your settlement attorney.

Who runs the closing

Delaware requires a Delaware-licensed attorney to conduct or supervise real estate closings.

Property taxes and escrow

Delaware county and school taxes run July 1 to June 30. The annual bill goes out in summer and is due September 30, so taxes are paid in advance and the seller is usually credited for the unused part of the year. Some towns bill separately on their own schedule.

Buying in Delaware: questions

How much transfer tax does a buyer pay in Delaware?

Usually half of 4%, or about 2% of the price. On a $400,000 home that is roughly $8,000, less any first-time buyer relief.

Is there a first-time homebuyer transfer tax exemption in Delaware?

Yes. A first-time buyer’s share of the state tax drops by 0.5% of the price on up to $400,000, and counties exempt first-time buyers on at least the first $400,000. It lowers only the buyer’s half.

When are property taxes paid in Delaware?

Delaware’s annual county and school tax bill is due September 30 for the July-to-June year, so it is paid in advance. Buyers usually reimburse the seller at closing for the months after the sale.

How much are closing costs in Delaware?

On a $370,000 home with 20% down on a conventional loan, the calculator’s estimates put a Delaware buyer’s closing costs at about $19,835, or 5.4% of the price, and cash to close at $93,835. Delaware’s taxes on the buyer come to $7,400 of that: realty transfer tax (half) $7,400. Lender fees, insurance and the rate vary, so put in your lender’s Loan Estimate for a closer number.
