Selling in Delaware: what to know

Realty transfer tax

Delaware’s realty transfer tax is usually 4% in total: 2.5% to the state plus 1.5% to the county or town. Where a locality levies less than 1.5%, the state rate is 3% instead. By law it is split equally between seller and buyer, so on a $400,000 sale each side pays about $8,000.

Title insurance

The buyer customarily pays for the owner’s policy in Delaware. Confirm with your settlement attorney.

Who runs the closing

Delaware requires a Delaware-licensed attorney to conduct or supervise real estate closings.

Property taxes

Delaware county and school taxes run July 1 to June 30. The annual bill goes out in summer and is due September 30, so taxes are paid in advance and the seller is usually credited for the unused part of the year. Some towns bill separately on their own schedule.
