Buying in Texas: what to know

No buyer’s taxes

Texas has no buyer-paid transfer or mortgage tax. The buyer’s lender’s title policy is $100 when issued with the owner’s policy, and endorsements are priced separately.

No state transfer tax

Texas has no state or local real estate transfer tax; only county recording fees apply.

Title insurance

Texas title premiums are set by the Texas Department of Insurance, and new rates about 6.2% lower took effect March 1, 2026. The premium is $780 at $100,000, then $4.94 per $1,000 up to $1 million and less per $1,000 above, so $2,262 on a $400,000 home. The seller customarily pays for the owner’s policy; the standard Texas contract has a box for seller or buyer. A lender’s policy issued at the same time costs $100 when the loan doesn’t exceed the price.

Who runs the closing

Title companies close Texas sales. An attorney isn’t required; under the standard contract the seller pays a small fee for deed preparation.

Property taxes and escrow

Texas taxes the calendar year, billed around October and delinquent February 1 of the next year, so taxes are paid in arrears. The seller credits the buyer from January 1 to closing.
